Jurors Hear Closing Arguments in Grace Case
Lawyers from both sides presented their closing arguments Wednesday as the W.R. Grace & Co. trial comes to a close.
The prosecution began their closing arguments when Assistant U.S. Attorney Kris McLean opened by covering the conspiracy charges while attorney Kevin Cassidy concluded by reviewing the charges of knowing endangerment and obstruction of justice.
McLean covered around 50 documents from 1972 to 2003 that he argued were examples of Grace putting profits over safety.
Next defense attorney David Bernick argued that the government had a flawed case and had taken the EPA's script and rewritten it into a case. Bernick used a white board and charts to reiterate his argument that the government had no case against the executives.
Earlier in the day, Judge Donald Molloy presented more than 50 instructions to the jury and defined terms that had been used throughout the trial. Molloy instructed jurors not to consider the testimony of Robert Locke whose testimony became a heated issue after it was discovered he may have contradicted himself.
In addition Molloy instructed jurors not to use part of the testimony from Dr. Alan Whitehouse. He instructed jurors to disregard testimony related to his asbestos predictions but to consider the rest of his testimony. Dr. Whitehouse is a pulmonologist who has treated many former Grace employees.
