Insurance Companies Prepare to Battle Scottish Government

Insurance companies are warning the Scottish government that they will take legal action should it pass legislation allowing people with pleural plaques to receive compensation.

Pleural plaques develop from thickening lung tissue caused by exposure to asbestos. Last year the House of Lords ruled that people diagnosed with pleural plaques should not be allowed to file claims for compensation.

The court ruled that the only major concern for those with plaques involved anxiety over whether they could later develop diseases like mesothelioma. The plaques themselves do not develop into cancer or other lethal conditions but are a litmus test for asbestos exposure.

Insurance companies argue that the plaques are not symptomatic of an asbestos related disease and that allowing compensation would open the door for frivolous litigation. They argued that increased insurance premiums as a result of lawsuits would create more of a burden to workers.
