Construction company dumped unapproved asbestos material at a landfill

Newport News, VA - State officials confirmed this week that debris dumped at a Suffolk landfill did contain asbestos, despite the initial denial from the contractor who dumped it.

The state Department of Environmental Quality tested samples from 20 truckloads of debris that were dumped at the site a few weeks ago and verified the presence of asbestos. The debris was from a $14 million Navy housing construction site.

DEQ compliance manager Milt Johnston said the agency will probably not issue a fine to the contractor, Cinter Construction Co. Inc. However, Cinter will have to pay the landfill owner $60,000 for the cost of dumping clean waste instead of asbestos-tainted waste at the site.

The landfill is only authorized to accept nonfriable asbestos material so there is a chance Cinter may be fined for dumping asbestos that doesn't meet that requirement, but Johnston said the level of proof may not be there.

John Holland, the landfill owner, said he was suspicious when the debris from the Navy housing site arrived and wasn't classified as containing asbestos. He had given a different company an estimate for the construction site's asbestos-contaminated debris a month ago.

Holland said he and his men have taken care of the asbestos and will bill the costs to Cinter in due time.
