Deceased asbestos poster girl's family wins compensation
Manchester, U.K. – Martha Charlson's family has been awarded a five figure settlement in a lawsuit over her death, which was a result of an asbestos-related disease.
Mrs. Charlson was the poster girl for Turner and Newall, formerly the world's largest asbestos producer, during the company's peak period. She had appeared one of the firm’s booklets, helping promote its acceptable image. The photo, taken in 1957, in the booklet showed her working at a very clean asbestos spinning machine on the factory floor of Turner Brothers in Rochdale. However, the harsh conditions she and her fellow workers experienced were in no way similar to the picture.
Mrs. Charlson started working for the company when she was 16 and stayed there for 48 years, working with asbestos-treated yarn. Her daughter, Louise Keefe, said that that her mother fell ill the day after she retired. Mrs. Charlson died in 2002 at the age of 64, only a few months after she was diagnosed with the cancer.
Turner and Newall was acquired by American-based Federal Mogul in 1997, which became responsible for all lawsuits against T&N. Federal Mogul would not have been able to survive if it was required to pay all the claims at once. The company filed for Chapter 11 Bankruptcy, which allowed it to place the claims on hold while the company continued operating.
The compensation that Mrs. Charlson's family, as well as the other claimants, is now receiving is coming from a trust set up by court administrators on orders from the High Court, which Federal Mogul is responsible for paying off over time.
