Mesothelioma sufferer receives payout from large manufacturer

Queensland, Australia - A man suffering from an asbestos-related illness has received a payout for a Supreme Court case settlement against a former major supplier of asbestos building materials, James Hardie & Co Pty. Ltd.

Garth Clyde Copp, 52, came to an agreement with Hardie, which has changed its name to Amaca Pty. Ltd., for an undisclosed amount during a court-ordered mediation session. The case never went to trial but according to court papers, he had initial sought $1 million in compensation.

Mr. Copp was diagnosed late last year with mesothelioma and was told he only had three months to live in 2008. In January, he filed a lawsuit for compensation against Hardie and another asbestos product manufacturer, claiming that they failed to provide adequate warnings about risks associated with handling asbestos.

Court documents revealed that he was exposed to asbestos while working with Hardie products during his career as a laborer in the 1970s and 1980s. Mr. Copp said he regularly breathed in asbestos fibers while performing tasks such as cutting asbestos cement pipes and sanding back asbestos cement walls.

During early court proceedings, the Supreme Court allowed him to give his testimony from home due to his dramatically deteriorated condition.

Mr. Copp has said he's extremely relieved that the court proceedings are over and was pleased that the companies had taken responsibility for contributing to his disease.
